Localism Bill Voted Through Commons


The Localism Bill passed through the Report Stage and Third Reading in the House of Commons on 17 and 18 May 2011 and will now go before the House of Lords. The Second Reading in the House of Lords is expected to begin on 7 June 2011.

Planning Conditions and Temporary Permissions

The recent case of Avon Estates Ltd v Welsh Ministers [2011] EWCA Civ 553 considered the effect of a permanent condition attached to a temporary planning permission after the expiry of that period.

Pilot Neighbourhood Plans

On 17 May 2011, Planning Minister Greg Clark announced eight pilot business areas which will be asked to develop a business led Neighbourhood Plan for town centres and local businesses that will benefit the whole community.

Enforcement by Injunction

In the Court of Appeal case of Westminster City Council v Davenport [2011] EWCA Civ 458, an appeal against a decision which granted an injunction to a local authority restricting the use of a property to residential use was dismissed. It was held that the injunction was appropriate as the permitted use of the property was clear and the local authority's right to an injunction could not be defeated by the occupier's assertion that broader uses were permitted.
