Sexual Orientation and Religious Belief - Update

Last month we reported on the Employment Appeal Tribunal (EAT) case of McFarlane v Relate Avon Limited. In McFarlane, the EAT based their approach on the widely publicised case of Ladele v London Borough of Islington. Since then, the Court of Appeal has handed down its judgement in Ladele, affirming the EAT's approach to both cases.

Re-Opening Compromise Agreements

In December 2009 the Employment Appeal Tribunal gave judgment in the case of Industrious Ltd v Horizon Recruitment Ltd (in liquidation) and Mrs J Vincent.  The EAT held that tribunals have jurisdiction to determine whether a compromise agreement is unenforceable because of misrepresentation.

Dress Codes and Appearance Policies - Sex Discrimination

The recent Employment Appeal Tribunal case of Dansie v The Commissioner of Police for the Metropolis confirmed established legal principles relating to dress codes and how they can apply differently to men and women.
