The general rule is that an employer is under no duty to provide a character reference for an employee or ex-employee but if it does provide a reference then it should take care to provide a reference which is true, accurate and fair, otherwise it may incur liability. This has been revisited in the Court of Appeal case of Jackson v Liverpool City Council (LCC).
