New DOJ Guidelines: Fig Leaf to Avoid Legislation?

 

For the fifth time in a decade, the United States Department of Justice (the "DOJ") has issued a new policy for the investigation and prosecution of business organizations.  This policy seemingly prohibits the DOJ outright from considering a business organization's decision to waive attorney-client and work product privileges as a factor in assessing an entity's cooperation.  For EU and UK companies doing business within the United States, the new policy will have an impact on them should they become enmeshed in a criminal inquiry led by U.S. prosecutors. 

 

Increased And Varied FCPA Enforcement Involving the Energy Sector

 

Energy companies face increased prosecutions under the Foreign Corrupt Practices Act (FCPA), with severe consequences. More aggressive international enforcement and cross-border cooperation are emerging trends of which companies must be aware.
